A United States based policy advisory and lobbying firm, Von Batten-Montague-York, says President Bola Tinubu could face criminal charges in the United States after leaving office.

The firm made the claim in a social media post on Tuesday, citing its review of filings involving the Federal Bureau of Investigation and the Drug Enforcement Administration.

However, the firm acknowledged that the documents it reviewed do not explicitly establish that the US government intends to charge President Tinubu.

It said responses from the FBI and DEA to separate enquiries have raised questions about whether any law enforcement investigation or proceeding relating to the matter may still exist.

According to the firm, the two agencies were asked on separate occasions to confirm that no investigation or enforcement proceeding concerning the allegations was pending, more than 30 years after the alleged offences. The firm said both agencies declined to confirm or deny whether such an investigation or proceeding exists, stating that they are not obligated to comment on the matter.

Based on its interpretation of some of the court filings, Von Batten-Montague-York said it believes President Tinubu could face criminal charges after leaving office, when he would no longer enjoy immunity from criminal prosecution as a sitting head of state.
